The terms and conditions below apply to all visitors of our website. Please read these terms and conditions carefully, especially those pertaining to exclusions of liability, privacy and confidentiality.

In these terms and conditions: “Student”, “You” or “Your” refers to any persons accessing this website. “The Company”, “Ourselves”, “We” and “Us”, refers to Together We Pass. “Party”, “Parties”, or “Us”, refers to both you and ourselves or either of us. Any words expressing the singular shall be deemed to include the plural and vice versa and reference to any one gender shall include the other.  Any reference to persons includes both legal and natural persons. These terms and conditions shall be interpreted and applied in accordance with the laws of the Republic of South Africa.

 

Privacy and Confidentiality

We are committed to maintaining the confidentiality, integrity and security of your personal information and use both technological and procedural safeguards to protect it. We abide by the Protection of Personal Information Act.

 

We will not sell, share, or rent your personal information to any third party or use your e-mail address for unsolicited mail. Any emails sent by this Company will only be in connection with the provision of agreed services and products.

 

Only authorized employees on a need to know basis have access to and use of personal information collected from individual customers. We regularly review our systems and data management processes to ensure the best possible service to our customers. The laws of the Republic of South Africa lay down  specific offences for unauthorised actions against computer systems and data, and as such we will investigate any unauthorised actions with a view to prosecuting and/or taking civil proceedings to recover damages against those responsible.

 

Any information concerning the Students and their respective Student records will not be passed by us to third parties without the Student’s express or implied consent. Student academic records are regarded as confidential and therefore will not be divulged to any third party without the express prior consent of a Student unless we are legally required to do so to by appropriate legal authorities. Students making use of our services have the right to request sight of, and copies of any and all Student records we keep regarding them, on the proviso that we are given reasonable notice of such a request.

 

Students are requested to retain copies of any literature issued in relation to the provision of our services. Where appropriate, we shall issue Student’s with  any written information, hand-outs or copies of records as part of an agreed contract, for the benefit of both parties.

 

Pledge

All students and lecturers must abide by the Together We Pass Pledge.

 

Ads

Third party vendors, including Google, use cookies to serve ads based on a user’s prior visits to our website.

 

Google’s use of the Double Click cookie enables it and its partners to serve ads to our users based on their visit to our site and/or other sites on the Internet.

 

Users may opt out of the use of the Double Click cookie for interest-based advertising by visiting Ads Settings.

 

Content Posting

Where you make use of any forum accessible via our website or any Together We Pass forum hosted by a third-party service provider on our behalf, you agree to follow certain policies and rules when posting content, including any policies or rules published by the third-party service providers, including social media platforms like Facebook, Twitter, LinkedIn and others.

You indemnify us fully in respect of any claims made against us arising from your breach of the provisions of this paragraph.

 

You may not post or transmit any message which is defamatory, or which discloses private or personal matters concerning any person. You may not post or transmit any message, data, image or programme that is indecent, obscene, pornographic, harassing, threatening, abusive, hateful, racially or ethnically offensive; that constitutes hate speech or that encourages conduct that would be considered a criminal offense, incitement to violence, to give rise to civil liability or violate any law; or that is otherwise inappropriate.

 

You may not post or transmit any message, data, image or programme that would violate the property rights of others, including unauthorised copyrighted text, images or programmes, trade secrets or other confidential proprietary information, and trademarks or service marks.

 

You may not interfere with other users’ use of the website or our services, including, without limitation, disrupting the normal flow of dialogue in any forum area of our website, deleting or revising any content posted by another person or entity, or taking any action that imposes a disproportionate burden on our website or service infrastructure or that negatively affects the availability of the website or the service to others.

 

You may not advertise your own products or services, post or transmit chain letters, charity requests, petitions for signatures; employment or other business, investment or savings opportunities or letters relating to Ponzi or pyramid schemes.

Unsolicited emails, mailings, telephone calls, or other communications to individuals or companies whose contact details you obtain through our website or service are prohibited.

 

Exclusions and Limitations

The information on this website is provided on an “as is” basis. To the fullest extent permitted by law, Together We Pass excludes all representations and warranties of any kind, express or implied, relating to this website and its contents, or which is or may be provided by any affiliates or any other third party, including in relation to any inaccuracies or omissions in this website and/or our literature or study materials and excludes all liability for damages as a result of or attributable, whether directly or indirectly, to the use or inability to use this website.

 

This includes, without limitation, direct loss, loss of business or profits (whether or not the loss of such profits was foreseeable, arose in the normal course of business  or you have advised us of the possibility of such potential loss), damage caused to your computer, computer software, systems and programs and the data thereon or any other direct or indirect, consequential and incidental damages.

 

We shall have absolutely no liability to you or your dependents in any way for any loss suffered as a result of academic results.

 

The above exclusions and limitations apply only to the extent permitted by law.

Force Majeure

Neither party shall be liable to the other for any failure to perform any obligation under any Agreement which is due to an event beyond the control of such party including but not limited to any act of God, terrorism, war, political insurgence, insurrection, riot, civil unrest, act of civil or military authority, uprising, earthquake, flood or any other natural or man-made eventuality outside of our control, which causes the termination of an agreement or contract entered into, nor which could have been reasonably foreseen.

 

Any Party affected by such event shall forthwith inform the other Party of the same and shall use all reasonable endeavours to comply with the terms and conditions of any Agreement contained herein.

 

Waiver

Failure of either Party to insist upon strict performance of any provision of this or any Agreement or the failure of either Party to exercise any right or remedy to which it, he or they are entitled hereunder shall not constitute a waiver thereof and shall not cause a diminution of the obligations under this or any Agreement. No waiver of any of the provisions of this or any Agreement shall be effective unless it is expressly stated to be such and signed by both Parties.
